Unlocking Corporate Tax in Hong Kong :
The Real Rates, Rules & Myths

Hong Kong is not tax-free, but it is one of Asia’s most competitive low-tax jurisdictions with its two-tiered tax system : 8.25% on the first HK$2 million of assessable profits and 16.5% thereafter. Only profits sourced in Hong Kong are generally taxed. That is why founders comparing Hong Kong with Singapore, Dubai and the British Virgin Islands (BVI) often shortlist it first.

Many founders assume Hong Kong is a “tax-free haven” because of its simple tax system, low compliance burden and competitive rates. The reality is more nuanced: the Hong Kong tax system is low-rate and rules-based, and understanding those rules helps founders plan with confidence.

In this guide :

Quick Verdict

  • Is Hong Kong tax-free? No. It is low-tax, with 3 direct taxes : Profits Tax, Salaries Tax and Property Tax.
  • Hong Kong profit tax rate : 8.25% on the first HK$2 million, then 16.5%.
  • Tax basis : Territorial. Profits are generally taxed by where they are sourced, not where the company is incorporated.
  • Compliance : Accounting records, tax filings and audits still apply.

Is Hong Kong Really Tax-Free? 3 Myths Debunked

Myth #1: Is Hong Kong Completely Tax-Free?

Reality : No. Hong Kong is low-tax, not tax-free. It levies three direct taxes : Profits Tax, Salaries Tax and Property Tax.

Tax Rate Applies to
Profits Tax 8.25% on first HK$2m;
16.5% thereafter
Businesses on Hong Kong-sourced profits
Salaries Tax Progressive rates (2%-17%)
*Taxpayers generally pay whichever amount is lower.
See GovHK Salaries Tax Rates below.
Employees and directors
Property Tax 15% of net assessable value Owners of Hong Kong property

Hong Kong generally does not levy:

  • Capital gains tax
  • Withholding tax on dividends or interest
  • VAT or GST
  • Estate duty
  • Tax on dividends received

Myth #2 : Are all profits of a Hong Kong company taxable?

Reality : No. Under Hong Kong’s territorial tax system, only profits sourced in Hong Kong are generally subject to Profits Tax. Incorporating a company here does not automatically bring its global income into the tax net.

The Inland Revenue Department (IRD) generally looks at where the profit-generating activities take place, including :

  • Business operations
  • Contract negotiation and execution
  • Service delivery
  • Management and commercial decision-making
  • Where goods are bought and sold

Foreign-sourced passive income can be taxable in some cases. Under the Foreign-Sourced Income Exemption (FSIE) regime, in force since 1 January 2023, dividends, interest and certain IP income received in Hong Kong by multinational enterprise (MNE) entities may be taxed unless economic-substance requirements are met.

Myth #3 : Does a low tax rate mean less compliance?

Reality : No. A low tax rate does not reduce compliance duties. Hong Kong companies are generally required to keep accounting records, file profits tax returns and arrange an annual audit.

Core compliance duties for a Hong Kong company include :

  • Keep accounting records and supporting documents (contracts, invoices, bank statements) for at least 7 years
  • Prepare financial statements for each financial year
  • Arrange an annual audit by a Hong Kong practising CPA (limited exceptions apply, such as dormant companies)
  • File the Profits Tax Return when the IRD issues it, generally within 1 month of the issue date
  • File the Annual Return with the Companies Registry within 42 days of the incorporation anniversary
  • Renew the Business Registration Certificate before it expires

Good records are the strongest support for your tax position.

3 Founder Takeaways on Corporate Tax in HK

1. Low tax, clear rules. Hong Kong’s advantage is a transparent tax framework, not the absence of tax, so knowing the rules helps you plan expansion with confidence.
2. Source matters. Tax treatment depends on where profits are earned, not just where the company is registered, which makes profit sourcing key if you serve several markets.
3. Compliance protects you. Accurate records and timely filings reduce risk and keep your company in good standing as it grows.

4 Steps to Make HK’s Tax System Work for You

So, is Hong Kong really tax-free?

No, but low rates, a territorial tax system and clear rules make it one of Asia’s most founder-friendly jurisdictions. The real advantage is a transparent, efficient framework that supports growth while staying globally competitive.

  1. Confirm where your profits are sourced. Map which activities generate income and where they take place.
  2. Document contracts and decision-making. Record where contracts are negotiated and signed, services are delivered and key decisions are made.
  3. Keep records and plan your audit. Retain accounting records for 7 years and schedule your audit and tax filings early.
  4. Check your home country’s tax rules. Also check whether Hong Kong’s foreign-sourced income provisions apply to your company.

Hong Kong Tax System FAQs Founders Ask Most

The corporate tax rate in Hong Kong is 8.25% on the first HK$2 million of assessable profits and 16.5% thereafter. Only one company in a connected group can claim the lower rate. Hong Kong also levies Salaries Tax and Property Tax on individuals and property owners (see table on Myth #1).

Not necessarily. Under Hong Kong’s territorial tax system, Profits Tax generally applies only to profits sourced in Hong Kong. The IRD looks at where the profit-generating activities take place, so profits from overseas operations may fall outside the tax net, depending on the facts and applicable provisions.

The IRD applies the ‘operations test’ : it looks at what the company did to earn the profit and where it did it. Under the Hong Kong tax system, registered address, place of incorporation and customer location do not decide the answer on their own. Keep clear records of contracts, transactions and activities to support your position.

Hong Kong offers competitive tax rates compared with Singapore and Dubai, while providing a more structured business environment than the British Virgin Islands (BVI).

Yes. Overseas founders can benefit when their Hong Kong company earns profits from activities conducted outside Hong Kong and those profits qualify under an offshore profits claim. In simple terms, offshore profits claims generally relate to business income earned outside Hong Kong, while the FSIE regime mainly concerns certain types of foreign-sourced passive income, such as dividends and interest.
